I was in a car accident. Now what do I do?

  1. CALL THE POLICE

It’s important to call 9-1-1 following an accident, even if there are no serious injuries. Having a police report may be necessary to make a claim to resolve your vehicle’s property damage with the insurance company.

  1. HELP CREATE AN ACCURATE RECORD

When an officer arrives on the scene, provide your full cooperation. Give a complete and accurate description of the incident. Obtain the names and phone numbers of all witnesses and take photographs of the entire scene; including the location of the incident, the vehicles involved, debris in the road, and the placement of any street cameras in the area.

Request a copy of the police report from the reporting officer.

  1. SEEK NECESSARY MEDICAL ATTENTION

If you are not taken by paramedics to the emergency room, it’s important that you still be examined by a physician. Often, automobile accident injuries are not immediately apparent. Most clients report feeling pain a day or two following an accident. Even in accidents involving minor impact, you can sustain a serious and permanent injury to your spinal cord. A small bump to the head, or even whiplash, can cause a concussion or closed head injury. For these reasons and more, it is imperative that you are seen by a medical doctor.

Florida Law requires that you be seen by a physician within 14 days of an accident to qualify for personal injury protection (“PIP”) benefits. If you wait too long before seeing a doctor, the insurance company may deny your claim.

  1. CALL 1-800-ASK-DAVE

After speaking to the police and obtaining emergency medical care, the most important step is to protect your rights. Your attorney can advise you on issues ranging from how to make sure you are fully compensated for your vehicle to how to make sure you are getting the best medical treatment available. Usually, the insurance companies will begin contacting you almost immediately following an accident and may try to pressure you into giving a recorded statement or even settling your personal injury claim. It is important to know your rights and legal options before speaking to any claims adjuster. If you’ve been involved in an auto accident, call 1-800-ASK DAVE now to receive a free consultation.
